 End-User Notice and License Agreement from Sourcery Software NOTICE TO END USER: Carefully read the following legal agreement. By Installing, copying or otherwise using the Software Product, you agree to be bound by the terms of this agreement. The Software Product includes computer software, the associated media, any printed materials and any "on-line" or electronic documentation. If you do not agree to the terms of this agreement, return the software product for a refund. Copyright: The software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software Product is licensed, not sold. License Grant: Sourcery Software grants you a non-exclusive license to use one copy of the software on the computer. Prohibited Uses: Without obtaining written permission from Sourcery Software, you may not (a,) use, copy, modify or alter the Software Product except as expressly provided in this License; (b,) translate, disassemble, decompile, reverse program or otherwise reverse engineer the Software Product; (c,) sublicense or lease the Software Product. Limited Warranty: Sourcery Software warrants that the Software Product will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of purchase. Any implied warranties relating to the Software Product are limited to such ninety (90) day period. Customer Remedies: If the Software product does not conform to the "Limited Warranty" section above, Sourcery Software's entire liability and your sole and exclusive remedy shall be, at Sourcery Software's option, either to (a,) correct the error; (b,) return of the price paid; or (c,) help you work around the error. This Limited Warranty is void if failure of the Software Product has resulted from accident, abuse or misapplication. Any replacement software will be warranted for the remainder of the original Limited Warranty period. No Other Warranties: Sourcery Software does not warrant that the Software Product is error free, except for the express limited warranty in the "Limited Warranty" section. Sourcery Software disclaims all other warranties with respect to the Software Product, either Express or Implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose and noninfringement of third party rights. This limited warranty gives you specific legal rights. You may have others which vary from state/jurisdiction to state/jurisdiction. No Liability for Consequential Damages: In no event shall Sourcery Software be liable for any damages whatsoever (including without limitation, direct or indirect damages or personal injury, loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Software Product, even if Sourcery Software has been advised of the possibility of such damages. Limitation of Liability: In no event shall Sourcery Software's liability for any claim, whether in contract, tort or any other theory of liability, exceed the license fee paid by you directly to Sourcery Software, If any. |
